Direct recruitment illegal in source countries

 


There are a few issues related to Human Resource. So I will share with all of you that read my blog 10 common issues in Human Resources.

For this first week I would like to share about recruitment issues.

The first issues that I have recently read is from New Straits Times. Based on what I have read in paper it is known that as Malaysian we have to go through a certain laws to apply for a foreign worker. As Malaysian we have to go through third party to apply for foreign workers and it might be a bit troublesome as it required many documents about the company and person in-charge. If we did not follow this laws, we might get jailed and will be charge as human trafficking. The requirements of the law in all Malaysia's source countries included Thailand, Cambodia, Nepal, Myanmar, Laos, Vietnam, Philippines, Pakistan, Sri Lanka, Bangladesh, Turkmenistan, Uzbekistan, Kazakhstan, India, Indonesia.

However, when it comes to our Malaysian workers, some countries doesn’t need to go through laws to take Malaysian as their workers. They can advertise and recruit us directly without have to go through any third party agents to deal with the embassy and it is also why we are always exposed by jobs scam. They advertise different jobs but when we arrived at their country, we will get a different jobs and will be lost contact with our family in Malaysia. The country have no rules on how they should have recruit Malaysian citizen.

Solution :

Embassy : need to tighten up the laws not only in Malaysia but all countries to protect the people of their country. They also have to discuss with each other on how to make the rules efficient and can be followed by everyone.

Community : need to concerned about everyone especially family members. Give advice to them if they want to work outside the country.

Individual : need to make sure the job advertisement is it legit or not. Ask for confirmation with the embassy and make a police report if the job advertisement is doubtful.
